1. English Version (App Terms of Use)

1.1. Scope & Gratuitous Provision

FredCam (the "App") is a mobile application developed by Frederik Trojahn ("we", "us", "our") and distributed through the Apple App Store. The App is provided completely free of charge. The contractual relationship for the usage of the App is gratuitous (subject to the statutory regulations for donations and loans under German law).

1.2. License Grant

We grant you a personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to download, install, and use the App on iOS devices that you own or control, strictly in accordance with these Terms and the Apple App Store Terms of Service.

1.3. Local Processing & System Permissions

FredCam operates entirely locally on your device. The App requires camera access to capture photographs and photo library access to save captured media and display gallery previews. Optionally, the App may request location access strictly if you choose to enable geotagging in Settings to embed GPS coordinates into local EXIF metadata. It is your responsibility to grant and manage these system permissions.

1.4. Disclaimer of Warranties

The App is provided "as is" and "as available," without warranty of any kind, express or implied. To the extent permitted by law, we do not warrant that the App will operate uninterrupted, error-free, or compatible with all device hardware configurations.

1.5. Limitation of Liability

Since the App is provided free of charge, our liability is strictly governed by the statutory provisions for gratuitous contracts under German law (§§ 521, 599 BGB):

• Liability Scope: We are liable only for intent (Vorsatz) and gross negligence (grobe Fahrlässigkeit).
• Exclusion of Slight Negligence: Liability for slight negligence (leichte Fahrlässigkeit) is completely excluded, including any liability for indirect, incidental, or consequential damages.
• No Liability for Data Loss: FredCam is a local-only application. Captured photos are saved directly into your device's native system Photo Library. We do not host or operate any server-side database or cloud backups. You are solely responsible for backing up your data (e.g., via iCloud or iTunes). We accept no liability for data loss unless caused by our intent or gross negligence.
• Exceptions: The above limitations and exclusions of liability do not apply to damages resulting from injury to life, body, or health.

1.6. Governing Law

These Terms of Use and any disputes arising out of or in connection with them shall be governed exclusively by the laws of the Federal Republic of Germany. If you are a consumer residing in the European Union, you are also protected by the mandatory consumer protection laws of your country of residence.
